Earlier last month, a man was killed when he lost control of his motorcycle after bumping into a Volkswagen. According to a report by WTOP, the motorcyclist was heading south on I-95 in Prince George’s County when the accident occurred. Evidently, the motorcyclist was traveling at a high rate of speed when he bumped into the Volkswagen and then lost control. Once he lost control, he fell off the bike and landed in the middle of the highway, where he was then struck by a passing tractor-trailer.
Police do not yet have any firm answers on what caused the accident, however, an in-depth investigation was conducted and a result is expected soon.
Motorcycle Accidents in Maryland: Not Always Cut and Dry
Reading the article mentioned above, it may seem easy to come to the conclusion that the motorcyclist was at fault for the accident because he was traveling at a “high rate of speed.” However, to assign blame so easily is to oversimplify the matter.
Determining legal fault in Maryland motorcycle accidents is not something that can be done on a whim. There are many factors that may come into play when determining who is at fault, and merely because a motorcyclist is travelling at a high rate of speed does not mean that he was not also a victim of another driver’s negligent or reckless conduct.
Recovering Compensation in a Maryland Motorcycle Accident
When a driver acts negligently and causes a motorcycle accident, the chances of causing serious injury is high. In fact, the chance of a motorcycle accident ending in death is much higher than that of an accident involving two cars. For this reason, motorcycle accident victims must be compensated substantially for their injuries, as well as for their pain and suffering.
Maryland is a tricky state to bring a personal injury action based on the negligence of another driver, however, due to the State’s somewhat strict laws restricting the recover of accident victims who are not completely free of fault. Therefore it is extremely important to secure the assistance of an experienced Maryland motorcycle accident attorney as soon as you can.
