According to a recent news report covering the tragic accident, two motorcycles were traveling at a high rate of speed when a vehicle pulled out of a hidden driveway. One of the motorcyclists was unable to avoid colliding with the car and slammed into the rear of the vehicle.
The motorcyclist who struck the driver’s vehicle was pronounced dead at the scene by emergency responders. The other motorcyclist stopped briefly before leaving the scene without providing any of his identifying information. However, he later contacted police and gave a statement. The driver of the car was taken to the hospital in critical condition. Police have begun an investigation into the fatal motorcycle accident but have not yet determined who will be cited. One of the issues that will have to be determined is whether the motorcyclist possessed the right-of-way or, since he was speeding at the time, he forfeited the right-of-way to the exiting motorist.
